Telephone Consumer Protection Act
The TCPA (Telephone Consumer Protection Act) is the primary federal law governing outbound telephone calls, text messages, and fax communications in the United States. Enacted in 1991 and amended multiple times since, the TCPA restricts the use of automated dialing systems, pre-recorded messages, and unsolicited contacts — directly impacting how VICIdial campaigns must be configured and operated.
How It Works in VICIdial
TCPA compliance in VICIdial involves multiple configuration areas. The abandon rate must stay below 3% of answered calls (enforced through adaptive dialing and the abandon rate target setting). The daily call limit setting prevents calling the same number too many times per day. DNC list management ensures numbers on federal or internal do-not-call lists are never dialed.
For calls to cell phones, TCPA requires prior express consent before using an automatic telephone dialing system (ATDS). VICIdial’s lead filter and list management features can segregate consented leads from non-consented leads, routing them to different campaigns with appropriate dialing modes — predictive for consented cell phones, manual dialing for non-consented contacts.
Abandoned calls must provide a safe harbor message identifying the caller, and the drop action setting configures this behavior.

TCPA violations carry statutory damages of $500-$1,500 per call, and class action lawsuits have resulted in settlements exceeding $100 million.
