Call Recording Compliance

Call recording compliance refers to adherence to federal and state laws governing the recording of telephone conversations. In the United States, laws vary by state — some states require only one party’s consent to record (one-party consent states), while others require all parties to consent (two-party or all-party consent states). VICIdial recording features must be configured and used in accordance with the applicable laws for each call.

How It Works in VICIdial

VICIdial’s campaign recording setting controls when and how calls are recorded. For compliance in two-party consent states, agents must notify callers that the call is being recorded before the recording begins. This is typically handled through an automated announcement at the start of the call (configured in the IVR/call menu) or by requiring agents to verbally disclose recording as part of their opening script.

For inbound calls, a recording disclosure can be played as part of the call menu greeting before the caller is connected to an agent. For outbound calls, the disclosure is typically part of the agent’s opening statement. Some VICIdial configurations use the start call URL to trigger recording only after the agent has delivered the disclosure.

VICIdial also supports the ALLFORCE recording mode, which prevents agents from pausing or stopping recordings — useful in environments where complete recording is required for compliance and quality control purposes.

Why It Matters

Recording calls without proper consent can result in significant legal liability. Two-party consent states like California, Florida, and Illinois impose criminal penalties and allow civil lawsuits for unauthorized recording. A single improperly recorded call can generate substantial damages in these jurisdictions, and class actions can compound the exposure dramatically.

Call centers using VICIdial that operate across state lines must apply the most restrictive applicable standard — typically treating all calls as requiring two-party consent. This means consistent recording disclosures for every call, regardless of the called party’s location.
